{"id":42062,"date":"2006-05-20T19:57:24","date_gmt":"2006-05-20T11:57:24","guid":{"rendered":"https:\/\/wp-productionenv-bjg9h2g2bgg5b8aa.southeastasia-01.azurewebsites.net\/news\/spacex-vs-boeing-and-lockheed-case-closed\/"},"modified":"2006-05-20T19:57:24","modified_gmt":"2006-05-20T11:57:24","slug":"spacex-vs-boeing-and-lockheed-case-closed","status":"publish","type":"post","link":"https:\/\/starpath.global\/news\/spacex-vs-boeing-and-lockheed-case-closed\/","title":{"rendered":"SpaceX vs Boeing and Lockheed: Case Closed"},"content":{"rendered":"<p>\u201cIT IS HEREBY ORDERED, ADJUDGED and DECREED that the Second Amended Complaint is dismissed with prejudice, that judgement is entered in favor of defendants, that the matter is closed.\u201d<\/p>\n<p>With those words on Thursday, Judge Florence-Marie Cooper of the US District Court of Central California closed the SpaceX vs. Boeing and Lockheed anti-trust lawsuit, dismissing SpaceX\u2019s last attempt to demonstrate injury and standing in the EELV marketplace.<br \/>\n<em><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/content.nasaspaceflight.com\/library\/1016\/logo2_1bk.jpg\" alt=\"\" width=\"182\" height=\"90\" align=\"right\" border=\"0\" hspace=\"5\" vspace=\"5\"><\/em><em>L2, one of the only places in the world you can view&nbsp;underground information on space flight in its&nbsp;full documented form.&nbsp;To join L2, click the advert \u2014&gt;<\/em><\/p>\n<p>**Click here for PDFs of the final rulings**<\/p>\n<p>The anti-trust lawsuit, filed by SpaceX last October, claims a history of anti-competitive behavior in the EELV programs by Boeing and Lockheed Martin violating the RICO, Sherman and Clayton acts.&nbsp; This behavior, the claims argued, culminated in harm to SpaceX by its exclusion form the USAF 2006 \u2018Buy 3\u2019 EELV Launch Services contracts, receipt of past and future Air Force subsidies, and the USAF\u2019s \u2018pre-allocation\u2019of EELV launches through 2011.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/images.cafepress.com\/product\/50514821v5_150x150_B.jpg\" alt=\"\" width=\"150\" height=\"150\" align=\"left\" border=\"0\" hspace=\"5\" vspace=\"5\">Judge Cooper stated \u2018the Defendants\u2019 conduct, whether anti-competitive or not, has not caused SpaceX any articulable injury\u2019, and dismissed the case with prejudice, without the hearing for oral arguments which had been scheduled for next month.&nbsp; She concluded \u2018SpaceX\u2019s alleged injuries arise either from past awards for which it was not eligible to bid or future claims that are speculative and unripe.\u2019<\/p>\n<p>This is, in fact, the second time the case has been closed.&nbsp; In February, after a brief hearing, Justice Cooper dismissed SpaceX\u2019s claims on the grounds SpaceX \u2018is not yet ready to compete with the Defendants in the EELV market.\u2019&nbsp; However, she did grant SpaceX the option to re-open the case by filing a second amended sets of claims.<\/p>\n<p>SpaceX reopened the case in March, insisting upon their viability as competitors to Boeing and Lockheed in the EELV launch market even though they have not yet launched their EELV-class Falcon 9 vehicle.\n<\/p>\n<p>SpaceX reminded the court that they had already secured a contract with an unnamed US Government customer for their first Falcon 9 flight slated for the summer of next year worth over $30 million.<\/p>\n<p><em><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/forum.nasaspaceflight.com\/forums\/get-attachment.asp?action=view&amp;attachmentid=4984\" alt=\"\" width=\"130\" height=\"128\" align=\"left\" border=\"0\" hspace=\"5\" vspace=\"5\"><\/em><em>STS-121 Mission T-Shirt.
