{"id":57698,"date":"2021-04-15T22:59:36","date_gmt":"2021-04-15T14:59:36","guid":{"rendered":"https:\/\/wp-productionenv-bjg9h2g2bgg5b8aa.southeastasia-01.azurewebsites.net\/news\/eu-court-rejects-eutelsat-viasat-challenge-to-inmarsat-ean-authorization-in-france\/"},"modified":"2021-04-15T22:59:36","modified_gmt":"2021-04-15T14:59:36","slug":"eu-court-rejects-eutelsat-viasat-challenge-to-inmarsat-ean-authorization-in-france","status":"publish","type":"post","link":"https:\/\/starpath.global\/news\/eu-court-rejects-eutelsat-viasat-challenge-to-inmarsat-ean-authorization-in-france\/","title":{"rendered":"EU Court Rejects Eutelsat, Viasat Challenge to Inmarsat EAN Authorization in France"},"content":{"rendered":"<\/p>\n<p><strong>The Court of Justice of the European Union (EU)<\/strong> issued a ruling Thursday that rejected a challenge by <strong>Eutelsat<\/strong> and <strong>Viasat<\/strong> against French regulator Arcep\u2019s authorization of <strong>Inmarsat<\/strong>\u2019s European Aviation Network (EAN).<\/p>\n<p>Arcep gave Inmarsat and its operating partner <strong>Deutsche Telekom<\/strong> access to frequencies and permission to operate complementary ground components for an in-flight connectivity service over France in 2018. Shortly after, Eutelsat and Viasat filed a challenge with France\u2019s Conseil d\u2019\u00c9tat (Council of State) claiming that Inmarsat was using the mobile satellite spectrum it was granted for services that were more attuned to cellular service.<\/p>\n<p>In the April 15 ruling, the EU court noted that mobile satellite systems do not necessarily have to be principally based, in terms of capacity of transmitted data, on the satellite component of that system. \u201cThe relevant provisions of the MSS decision do not define, in terms of capacity of transmitted data, the relationship between the satellite component of a mobile satellite system, on the one hand, and the ground component of that system, on the other,\u201d the court said.<\/p>\n<p>Inmarsat General Counsel Brad Swann welcomed the ruling and noted that the EAN platform complies with applicable EU rules. \u201cInmarsat welcomes the ruling of the European Court of Justice rejecting our competitors\u2019 arguments aimed at limiting the operation of the European Aviation Network,\u201d Swann said. \u201cEAN is an asset for Europe as a whole and it is proving very popular with passengers and airlines. Inmarsat looks forward to continuing to provide the rapidly growing number of EAN users with a world-leading in-flight connectivity experience.\u201d<\/p>\n<p>Viasat Vice President and Chief Litigation Counsel Colin Ward told<em> Via Satellite<\/em> that the company would continue to pursue its legal challenge of the Arcep authorization as it heads back to courts at the national level.<\/p>\n<p>\u201cWe appreciate the European Court of Justice\u2019s (ECJ) evaluation of the European Aviation Network (EAN),\u201d said Ward. \u201cThis is a highly-complex lawsuit, which requires in-depth evaluation and review\u2014at both the ECJ and national levels. We stand by our position that the EAN is illegal. Inmarsat has deployed a mobile satellite system that does not actually depend on the \u2018real and specific use of satellite communications\u2019\u2014an element required by today\u2019s ECJ decision.
