{"id":85713,"date":"2010-12-06T20:34:53","date_gmt":"2010-12-06T12:34:53","guid":{"rendered":"https:\/\/wp-productionenv-bjg9h2g2bgg5b8aa.southeastasia-01.azurewebsites.net\/news\/fcc-net-neutrality-ruling-still-faces-supreme-court-review\/"},"modified":"2010-12-06T20:34:53","modified_gmt":"2010-12-06T12:34:53","slug":"fcc-net-neutrality-ruling-still-faces-supreme-court-review","status":"publish","type":"post","link":"https:\/\/starpath.global\/news\/fcc-net-neutrality-ruling-still-faces-supreme-court-review\/","title":{"rendered":"FCC Net Neutrality Ruling Still Faces Supreme Court Review"},"content":{"rendered":"<p>[12-06-10] The <strong>U.S. Federal Communications Commission<\/strong> (FCC) ruled it will not reclassify broadband from \u201cInformation Service\u201d to \u201cTelecommunications Service,\u201d under the U.S. Communications Act of 1934, the FCC announced Dec. 1. <br \/>\n&nbsp;&nbsp;&nbsp; The initiative, FCC Chairman Julius Genachowski said in a statement, will ensure unblocked, non-discriminatory access to the Internet as part of the commission\u2019s pledge to maintain net neutrality.<br \/>\nThe announcement is in response to a judgment issued by the <strong>U.S. Washington D.C. Circuit Court of Appeals<\/strong> in April favoring Comcast \u2014 an ancillary authority case in which the FCC had taken action against the cable operator for blocking use by subscribers on its cable modem lines of certain peer-to-peer networking software.<br \/>\n&nbsp;&nbsp;&nbsp; Communications Law Attorney Owen Kurtin called the FCC\u2019s decision \u201ccommon sense\u201d and a victory for net neutrality proponents. \u201cThe FCC in making its announcement tacitly abandoned the \u2018third-way\u2019 approach it proposed on May 6, which would attempt to reverse its own arguments that broadband service is an information service, not subject to telephone-like common carrier regulation. At the time, the FCC saw the substantially unregulated information service classification as the best way to preserve the Internet\u00ca\u00bcs open access, low entry barrier structure. Subsequent events convinced the FCC that it had made a mistake,\u201d he said.<br \/>\n&nbsp;&nbsp;&nbsp; Genachowski said the FCC initiatives outlined in the ruling could go into effect as early as Dec. 21. However, the <strong>U.S. Supreme Cour<\/strong>t could still overturn the FCC\u2019s decision. \u201cThe Supreme Court could decide that the FCC are overreaching and that the<br \/>\n&nbsp;&nbsp; Brand X decision could be reasonably extended by affirming limited extent of the FCC\u00ca\u00bcs ancillary authority. The rulemaking will probably rely on Telecommunications Act authority to ensure broadband deployment.
